Charges and Appraisal Rate

Cebuana Lhuillier assures highest appraisal and security for pawned items. Advance interest will be charged four pesos (Php4 ) for every Php100 loan amount. To maintain the excellent standard of service offered by Cebuana Lhuillier, clients will be charged additional one percent (1%) of the principal loan, but not exceeding five pesos (Php5). No other hidden charges will be deducted from the loan.

Cebuana Lhuillier Pawnshop offers a minimum of 90 days upon maturity and a maximum of 4 months on repayment of loan.

Our interest rate for renewed transactions begins at 4% plus 2% liquidated damages and a Php5 service charge.

FAQs

Can I still renew or redeem my item even if I lost my pawn ticket

Yes. Immediately inform your branch of the loss so that we can prevent redemption by unscrupulous individuals. During renewal or redemption, you need to present a notarized affidavit of loss and valid ID

Will my jewelry item be damaged during appraisal

No. Our branch personnel are expertly trained to carefully appraise jewelry items. In some cases and with your permission, however, special tools may be needed to better appraise the items. The effects of these tools on your item will be barely noticeable.

Aside from jewelry items and appliances, what other items do you accept for pawning

Is my pawned item safe while in your custody

Yes, your item is safe because it will be placed in a sealed plastic pouch with your signature. This ensures that your item will never be tampered. Aside from this, we have enforced in every branch tight security measures to ensure the safety of the item you’ve entrusted with us.

Can I see my item even if I will not redeem it

As part of our security measures, we do not allow items to be brought out from the vault except when the item is redeemed. This is to ensure the safety and security of your items.

Can I redeem my item anytime during business hours

You can redeem your item anytime except on Sundays and after 5pm from Monday to Saturday.

How can I avoid foreclosure of my item

To avoid foreclosure, you need to renew or redeem your item on or before the expiry date, that is, 120 days from the loan date.

Will you be sending a notice/reminder prior to the expiration of my loan

Yes, we will send a notice via postal mail. Therefore, it is important that you provide us with your complete and updated address.

What happens to my foreclosed item

Foreclosed items are offered for public auction. The auction schedules are published in various tabloid newspapers.

Can anyone redeem the item on behalf of the pawner

We encourage our pawners to personally redeem their items. In the event that they are unable to do so, they may authorize another person to redeem the item on their behalf. Both the pawner and authorized representative must sign at the back portion of the pawnticket. Upon redemption, the representative must present the duly signed pawnticket along with the valid IDs of the pawner and the authorized representative. This is to ensure the safety and integrity of the item redemption and protection of our pawner.

Terms and Conditions

  1. The pawner hereby accepts the pawnshop’s appraisal as proper.
  2. The pawner agrees on the interest rates imposed in this contract of pledge. In case of dispute, the regular courts of law have the vested power to determine the reasonableness and legality of interest rates. The pawnshop hereby agrees not to collect advance interest for a period of more than one (1) year.
  3. The service charge is equivalent to one percent (1%) of the principal loan, but shall not exceed to five pesos (P5.00). No other charges shall be collected.
  4. This loan is renewable for such amount and period as may be agreed upon between the pawnshop and the pawner subject to the same requirements for a new loan.
  5. Upon maturity of this loan, as indicated on the face of this pawn ticket, the pawner has ninety (90) days from maturity date within which to redeem the pawn by paying the principal loan plus the interest that shall have accrued thereon.
  6. The amount of interest due and payable after the maturity date of the load up to the redemption period shall be computed upon redemption at the rate of provided above based on the sum of principal loan and interest earned as of the date of maturity.
  7. The pawnshop shall notify the pawner of any change in its business address/location through: (1) publication in English and in Filipino or in the local dialect in two (2) daily newspapers of general circulation in the city or municipality where the pawnshop is closing business and (2) posting in English and Filipino or in the local dialect for one (1) month after the date of publication in a conspicuous place in the premises to be vacated and to be transferred to.
  8. The pawner and pawnshop agree that the notice of auction shall be delivered via e-mail, SMS, or ordinary mail at_______________________ (check box of agreed mode and indicate the email address, mobile phone no., or complete residential address as may be appropriate, in the space provided). In case no mode of notification is agreed upon, the default shall be via ordinary. The pawnshop shall have the right to sell or dispose of the pawn in public auction if the pawner fails to redeem the pawn within the (90) day grace period. The pawnshop shall send the reminder on or before the expiration of the ninety (90) day grace period.
  9. The pawner shall advise the pawnshop of any change of address/mobile phone number/e-mail address.
  10. This ticket shall be surrendered at maturity date upon payment of the loan. In case of loss or destruction of this ticket, the pawner hereby undertakes to personally present an affidavit to the pawnshop before the redemption period expires. The pawnshop has two (2) days whether to accept: (1) the affidavit in place of the original pawn ticket, or (2) to issue a substitute pawn ticket, thereby cancelling the original.
  11. In case of pre-payment of this loan by pawner, the interest collected in advance shall accrue in full to the pawnshop.
  12. The pawner shall not be entitled to the excess of the public auction sale price over the amount of principal, interest and service fee: neither shall the pawnshop be entitled to recover the deficiency from the pawner.
  13. The pawner declares under the Anti-Fencing law that he is the owner of the property subject of this contract.
  14. The pawnshop shall excercise reasonable care and caution that an ordinary prudent person would as to his own property over the thing pawned in accordance with Republic Act No. 386 (Civil Code of the Philippines) as amended. Accordingly, the pawnshop shall insure all pawned items, except those which are kept inside a fireproof vault, in accordance with the pertinent regulations of the Bangko Sentral ng Pilipinas. Claims for restitution by pawners in case of loss, destruction or defect of the pawn due to robbery, fire and other fortuitous event, with or without the fault or negligence of the pawnshop, its owner, managing partner, directors and officers are cognizable by the regular courts.
  15. The pawnee shall not be liable for all the loss or damage of the article pawned due to fortuitous events or force mejure. When the loss is due to the fault and/or negligence of the pawnee, the amount of its liability, if any, shall be limited to the appraised value appearing on the face hereof.
  16. In case this loan is not paid on maturity date, the pawner herby agrees to pay in addition to accrued interest, 2 percent per month of principal, as liquidated damages. For purposes of computing the amount of liquidated damages, a fraction of the original term of the loan agreed upon as indicated at the face of the pawn ticket shall be considered as one full term.
  17. Venue of all judicial and administrative cases or proceedings with this contract shall solely and exclusively be brought before appropriate courts, departments, offices or agencies of the government situated in Parañaque City, Metro Manila.

BSP Circular

MANUAL OF REGULATIONS FOR NON-BANK FINANCIAL INSTITUTIONS – PAWNSHOPS

Pawnshops who transact with any pawner for the first time shall require the pawner to present the original and submit a clear copy of at least one (1) valid photo bearing identification document (ID) issued by an official authority.

The valid ID should indicate the address where the pawner resides, otherwise, pawner shall be required to present, together with the valid ID, a barangay certification or a copy of a billing statement that indicates the address where the pawner resides.

For this purpose, the term “official authority” shall refer to any of the following:

  1. Government of the Republic of the Philippines;
  2. Its political subdivisions and instrumentalities;
  3. Government-owned and/or controlled corporations (GOCCs); and
  4. Private entities or institutions registered with or supervised or regulated either by the BSP or the SEC or the Insurance Commission (IC).

Valid IDs include the following:

  1. Passport; inlcuding those issued by foreign governments
  2. Driver’s License
  3. Professional Regulation Commission (PRC) ID
  4. National Bureau of Investigation (NBI) Clearance
  5. Police Clearance
  6. Postal ID
  7. Voter’s ID
  8. Barangay Certification
  9. Government Service Insurance System (GSIS) e- Card
  10. Social Security System (SSS) Card
  11. Senior Citizen Card
  12. Overseas Workers Welfare Administration (OWWA) ID
  13. OFW ID
  14. Seaman’s Book
  15. Alien Certification of Registration/ Immigrant Certificate of Registration
  16. Government Office and GOCC ID, e.g., Armed Forces of the Philippines (AFP ID), Home Development Mutual Fund (HDMF ID)
  17. Certification from the National Council for the Welfare of Disabled Persons (NCWDP)
  18. Department of Social Welfare and Development (DSWD) Certification
  19. Integrated Bar of the Philippines ID
  20. Company IDs issued by private entities or institutions registered with or supervised or regulated either by the BSP, SEC or IC
  21. Passports issued by foreign governments

The foregoing shall be in addition to the customer identification requirements under Rule 9.1.c of the Revised Implementing Rules and Regulations (RIRRs) of R.A. No. 9160, as amended (Anti-Money Laundering Act), which requires pawnshop to obtain the following minimum information / documents from pawners:

  1. Name;
  2. Present address;
  3. Permanent address;
  4. Date and place of birth;
  5. Nationality;
  6. Nature of work and name of employer or nature of self-employment/business;
  7. Contact numbers; and
  8. Specimen signature.

A copy of the ID, barangay certificate and/or billing statement shall be kept by pawnshops for convenience of the pawner who continues to transact with the pawnshop but said documents should be updated at least every three (3) years. Pawnshops shall post excerpts of the above requirements conspicuously in its principal place of business and branches. The poster (shown as Appendix 7) shall not be smaller than 8.5 x 11 inches.

Loan Limit. Pawnshops may grant such amount of loans as may be agreed upon between the parties. The amount of loan shall in no case be less than thirty percent (30%) of the appraised value of the security offered, unless the pawner manifests in writing that he is applying for a lesser amount. Pawnshops shall not underappraise the security offered for the loan to circumvent the restriction prescribed by this Section.

Interest and Surcharges. The rate of interest including surcharges on any loan or forbearance of money extended by a pawnshop shall not be subject to any ceiling. However, pursuant to a decision of the Supreme Court (case of Medel, et al vs Court of Appeals, GR No. 131622 dated 27 November 1998) the interest rate shall not be iniquitous, unconscionable, or contrary to morals, if not against the law as may be determined by the Court. No pawnshop shall collect interest on loans in advance for a period of more than one (1) year.

Rate of interest in the absence of stipulation. The rate of interest for a loan or forbearance of money in the absence of an expressed contract as to such rate of interest, shall be twelve percent (12%) per annum.

Other charges. In addition to interest, pawnshops may impose a maximum service charge of five pesos (P5.00), but in no case to exceed one percent (1%) of the principal loan. No other charges, such as but not limited to insurance premium for the safekeeping and conservation of the pawned item, shall be collected.

Past Due Accounts; Renewal

A loan may be renewed for such amount and period as may be agreed upon between the pawnshop and the pawner, subject to the same conditions provided in this Part for new loans. No loan shall be renewed or its maturity date extended unless a new pawn ticket as defined in Sec. 4102P shall be issued indicating the new term of the loan agreed upon by the pawnshop and the pawner.

Right of pawner to redeem pawn within ninety (90) days from maturity

A pawner who fails to pay or renew his loan with a pawnshop on the date it falls due shall have ninety (90) days from the date of maturity of the loan within which to redeem the pawn by paying the principal amount of the loan plus the amount of interest that shall have accrued thereon. The amount of interest due and payable after the maturity date of the loan shall be computed upon redemption based on the sum of the principal loan and interest earned as of the date of maturity. The procedures to be followed in case the pawner fails to redeem his pawn are prescribed in Sec. 4324P.

If the maturity date of the loan or expiry date of redemption period falls on the pawnshop’s non-business day, a regular holiday or a special non-working holiday in the locality, then the maturity date of the loan or expiry date of redemption period shall be on the next business day.

If the pawnshop is closed on the maturity date of the loan or expiry of the redemption period, with or without prior notice to the pawner, then the maturity date of the loan or expiry of redemption period shall be on the next business day and the pawnshop shall not charge additional interest or surcharge to the pawner. If the pawnshop is closed due to a robbery, then the maturity date of the pledge or expiry of redemption period shall be on the next business day when the pawnshop opens for business and the pawnshop shall not charge additional interest or surcharge to the pawners.

Redemption of Pawns.

A pawnshop shall not release any pawn without first requiring the pawner to present and surrender the corresponding pawn ticket. If the pawn ticket was lost and could not be presented or surrendered, the pawnshop shall require the owner-pawner to execute and submit an affidavit of loss and shall ascertain the identity of the pawner, to ensure that the pawned item is released only to the owner-pawner.

The pawnshop shall return the pawn in the same condition when they were first pawned by pawner, upon full settlement of the loan.

Notices to the Pawner and to the Public

ON OR BEFORE THE EXPIRATION OF THE NINETY (90)-DAY GRACE PERIOD, A PAWNSHOP SHALL NOTIFY A PAWNER IN WRITING THAT THE PAWN SHALL BE SOLD OR OTHERWISE be DISPOSED OF, lN THE EVENT THE PAWNER FAILS TO REDEEM THE PAWN WITHIN THE NINETY (90)-DAY GRACE PERIOD, SPECIFYING IN THE SAME NOTIFICATION THE DATE, HOUR, AND PLACE WHERE THE SALE SHALL TAKE PLACE. The notice shall be sent through the mode of notification AGREED UPON BY THE PAWNER AND THE PAWNSHOP AS indicated AT THE BACK OF the pawn ticket at the time the loan was granted which may be through text/SMS message, electronic mail, FAX or by mail to the residential address. lf sent through text/SMS, the pawnshop shall obtain a report from the appropriate Telecommunications Company (TELCO) indicating that a text/SMS message was sent to the mobile phone number given by the pawner. The report of the TELCO shall be made available to BSP upon request.

IN CASE NO SPECIFIC MODE OF NOTIFICATION IS AGREED UPON AND INDICATED AT THE BACK OF THE PAWN TICKET, THE MODE OF NOTIFICATION SHALL BE BY ORDINARY MAIL. PAWNSHOPS SHALL EXERT REASONABLE EFFORT TO NOTIFY THE PAWNER AND PUT ON RECORD IF IT IS UNABLE TO DO SO. PAWNSHOPS SHALL MAINTAIN PROOF OF THE NOTICE TO PAWNER.

If upon the expiration of the ninety (90)-day grace period, the pawner fails to redeem his pawn, the pawnshop may sell or dispose of the pawn only after it has published a notice of public auction of unredeemed articles held as security for loans in at least two (2) newspapers circulated in the city or municipality where the pawnshop has its place of business, six (6) days prior to the date set for the public auction.

The notice shall be in English, and in either Filipino or the local dialect and shall contain the following:

  1. Name and address of the owner of the pawnshop; and
  2. Date, hour and place of the auction sale.

In remote areas where newspapers are neither published nor circulated, the publication requirement shall be complied with by posting notices at the city hall or municipal building of the city or municipality and in two (2) other conspicuous public places where the pawnshop has its place of business.

Terms and Conditions

1. GENERAL PROVISIONS:
  1.1. DEFINITIONS
      • Cebuana Lhuillier Rural Bank (“CLRB” or the “Bank”) – A rural bank duly registered with the Bangko Sentral ng Pilipinas (BSP) and licensed as an Electronic Banking and Electronic Money Issuer.
      • Cebuana Lhuillier Pawnshop (or “Cash Agent”) – is the accredited 3rd party service provider of the CLRB.
      • Deposit Account – This refers to interest- or non-interest-bearing deposits which are withdrawable upon demand thru available bank channels.
      • Micro Savings Account – refers to an interest bearing deposit which is linked to the 24k Cebuana Card or other proprietary card that may be issued by CLRB which may be accessed thru its channels such as but not limited to Cash Agents. Should the Client exceed the maximum balance of PHP50,000.00, the Bank shall convert the basic deposit account to a regular deposit account thus the terms and conditions for regular deposit accounts shall apply.
      • e-Money Account – An account that stores Philippine Peso (Php) value which resides in the e-Money system. It may be linked to the Account Holder’s electronic device such as mobile phone and which may be evidenced by a physical 24k Cebuana Card or other proprietary card that may be issued by CLRB
      • Know Your Customer (KYC) – is a process to establish the full identity of individuals looking to transact with a financial firm, which is usually done by requiring identification cards from a client as required by the Bangko Sentral ng Pilipinas (BSP).
      • Personal Identification Number (PIN) – a personalized digit code used to access the account and make transactions.
      • Cebuana Lhuillier 24K Card (or “24k Card”) – a valid and unexpired rewards card issued by a Cebuana Lhuillier Pawnshop or Cebuana Lhuillier PeraPadala outlet to qualified clients who become entitled to exclusive privileges, discounts, freebies, and special service offerings. It is non-transferable and must be presented only by bonafidecardholders
    1.2 THE AGREEMENT – This Agreement governs the relationship between the Client and the Bank.. The Bank may enact, modify or amend these terms and conditions, from time to time, as are customary in the conduct of the banking business or are in its judgment necessary for the protection of the Client and the Bank.
    1.3 CLIENT INFORMATION –The Client hereby warrants that all information pertaining to his/her identity and personal circumstances are true and correct. The Client hereby allows the Bank to verify said information. Further, the Client confirms, declares and acknowledges that the mobile phone number and e-mail address provided to CLRB are owned/under the control of the Client and that, any communication made from and to the said mobile number and/or e-mail address shall be automatically treated by CLRB to be directly coming from the Client, unless otherwise advised in writing. The Client shall update, whenever required by the Bank, information provided during account opening, such as address, mobile phone number and email address and shall notify the Bank immediately, in writing, of any change in his/her contact details and information. The Bank shall hold these details as true and complete in the event that no update is given unless otherwise advised in writing.
    1.4 RECORD OF TRANSACTIONS – The Client is responsible for verifying the e-Money and/or Deposit transaction history details and records to make sure that there are no unauthorized transactions. The Client should likewise review and reconcile transaction records/details for any errors or unauthorized transactions promptly and thoroughly.
    1.5 ACCOUNT AND CARD SECURITY – The Client shall be responsible for the security of his/her 24K Card or other proprietary card that may be issued by CLRB and for the maintenance of his/her PIN and/or online password. The Client acknowledges that his/her PIN and/or password are known only by him/her, and not by anyone else, nor by the Bank or the Cash Agent. The Client shall be responsible for all transactions processed through the use of the 24K Card (or other proprietary card issued by the Bank) and the PIN and/or password whether or not the transactions were made with the Client’s knowledge or authority. The Client shall hold the Bank, the Cash Agent, its officers and employees free and harmless from any and all losses, damages, or liabilities incurred or suffered in connection with the Client’s disclosure of his/her PIN and/or password. In case the 24K Card or other proprietary card is lost, stolen or destroyed, the Client agrees to immediately notify the Bank by calling Cebuana CARES Hotlines of such loss within twenty-four (24) hours, via telephone from 9am-6pm, Monday to Sunday or submit a written report to any Cebuana Lhuillier branch. All activities and transactions made thru the use of the 24K Card or other proprietary card prior to the report of the loss shall continue to be the liability of the Client.
    1.6 REFERENCE NUMBER – Each successful transaction shall be evidenced by a system-generated Reference Number, which shall be transmitted to the Client’s enrolled mobile number, e-mail address or validation form, whichever is applicable, for records purposes.
  • TRANSACTION DATE – The Bank will effect the Client’s transactions provided there are sufficient cash value available in the Client’s deposit or e-money account. It is the responsibility of the Client to ensure that sufficient cash or cash value are available in the Client’s deposit or e-money account at all times to cover any of the transactions, immediate or scheduled, and that the 24k Card or other proprietary card is active. Any charges or penalties as a result of an unsuccessful transaction due to insufficiency of cash or cash value or cancelled card will be the sole responsibility of the Client and shall be for the account of the Client.
    1.8 ACTIVATION AND DE-ACTIVATION OF DEPOSIT / E-MONEY ACCOUNT FEATURES – CLRB reserves the right to add, discontinue or deactivate features or functions upon sixty (60) calendar daysnotice to the Client through SMS and/or email.
    1.9 TERMINATION/SUSPENSION OF ACCOUNT – The Client may request CLRB to terminate or suspend the Deposit/e-Money account by submitting a written request to the Cebuana CARES or any Cebuana Lhuillier Pawnshop branches. The Client shall remain responsible for any transactions made on the account until the time of termination or suspension of the use of the card. The Bank also reserves the right to terminate or suspend the Client’s use of the card or close the account at any time with or without prior notice, and in any of the following instances: a) discovery of any form of fraud; b) violation of any of the provisions of the terms and conditions and rules and regulations of CLRB supplementary thereto; and c) other grounds warranted by law. The Bank is authorized to report such termination, suspension or closure to the BSP or to any monitoring body of the BSP. The Client shall hold the Bank free and harmless from all liabilities, claims and demands arising from the above actions of the Bank.
    1.10 DISPUTES ON TRANSACTIONS – The details in the Deposit/e-Money Account’s transaction records are presumed true and correct unless the Client notifies the Bank thru Cebuana CARES in writing of any disputes thereon within fifteen (15) calendar days from the date of transaction. If no dispute is reported within said period, all transaction details and records are deemed true and correct. Disputed transactions shall only be adjusted once the claim/dispute has been properly processed, investigated, and proven to be in favor of the Client.
    1.11 EXCLUSION FROM LIABILITY – CLRB makes no warranty, express or implied, regarding the performance of this Agreement or the electronic banking functionalities or other services offered hereunder. CLRB electronic banking service is offered on an “as is” or “asavailable” basis without warranties of any kind, except those required by law and other rules and regulation issued by pertinent government agencies. CLRB further makes no warranty (1) as to the content, quality or accuracy of data or information provided by CLRB hereunder or received or transmitted using the electronic banking channels; (2) as to any service or product obtained using the electronic banking service; (3) that the electronic banking service will be uninterrupted or error-free; or (4) that any particular result or information will be obtained. CLRB shall not be liable for any loss, added cost, compensation, damage or liability that the Client may incur as a result of any delay, interruption or termination of the electronic banking transaction whether caused by administrative error, technical, mechanical, electrical or electronic malfunction or any cause beyond CLRB’s control (including but not limited to acts of God, labor disputes, failure of communication lines, interconnection problems, mobile phone signal/reception problems, interference or damage by third parties).
    1.12 LIMITATION OF LIABILITY – Subject to the provisions herein, if CLRB is found liable for any act or omission for any reason whatsoever, the liability of CLRB shall be limited to the amount of the relevant transaction or actual damages to the Client, whichever is lesser. CLRB shall not be liable to the Client for any indirect, special, exemplary, punitive or consequential loss or damages arising from the use of 24k Card or other proprietary card, including but not limited to lost opportunities or profit.
    1.13 ANTI-MONEY LAUNDERING – The Client warrants that he/she is aware of the provision of R.A. No. 9160 (Anti-Money Laundering Act of 2001) and acknowledges that his/her account is subject to the provisions of R.A. No. 9160, including any and all amendments, rules or regulations pertaining thereto. The Client hereby agrees to keep the Bank, its directors, officersand employees free and harmless from any and allliabilities for any action taken in compliance therewith.
    1.14 DATA PRIVACY – The Bank is committed to respecting and protecting data privacy rights of the Client as a data subject in accordance with R.A. 10173 (“Data Privacy Law of 2012”), its Implementing Rules and Regulations and other applicable laws of the Republic of the Philippines. In the course of providing services to the Client, CLRB and the Cash Agent may collect information (including personal information) relating to the Client, including the transactions, accounts, account information or records. For this purpose:
    • The Client agrees that he/she will receive transaction notifications, and be regularly updated by the Bank and its subsidiaries and affiliates (hereinafter, “Cebuana Lhuillier Group”)of their products and services, and thus understand fully that his/her foregoing information will accordingly be shared.
    • The Client understands that the information collected, to be processed and retained shall be for the following purposes: client identification; profiling; direct marketing and cross-selling of products; and compliance to BSP rules, AMLA and such other purposes that may be required or allowed by law. The Client has been informed that he/she have the option not to give the foregoing information, in which case he/she understands that his/her transaction will not be processed. The client has also been informed that he/she can make corrections to any inaccurate or deficient information and have the option to withdraw his/her consent prior to the processing of his/her transaction by emailing Cebuana Lhuillier at cebuanacares@pjlhuillier.com or calling Telephone Numbers: (02) 7759-9800/(02) 8779-9800
    • Any Concerns about Data Privacy can be reported by the Client to infoprivacy@pjlhuillier.com. Client is encouraged to visit https://privacy.gov.ph to know more about R.A. 10173.
    • The Client hereby certifies that the information provided to the Bank are freely and voluntarily given and are true and correct to the best of his/her knowledge. Further, the Client hereby authorizes the Bank and the Cebuana Lhuillier Group to disclose to its partners, agents or other clients his/her above information to aid in any and all investigations that may be initiated on account of, or in relation to any concerns that may arise out of this transaction.
    1.15 DISCLOSURE OF INFORMATION – The Client acknowledges that the Philippine government, United States government and governments of other foreign jurisdictions where transactions pertaining to his/her account may transpire, may require the Bank, its branches and agencies, and the Cebuana Lhuillier Group to disclose or produce information concerning his/her account. For this purpose, the Client hereby waives his/her rights under R.A. 1405 (Law on Secrecy of Bank Deposits), R.A. 6426 (Foreign Currency Deposit Act of the Philippines), R.A. 8791 (General Banking Law of 2000), or any other pertinent law or regulation, as the same may be amended from time to time, and hereby authorizes the Bank, its branches and agencies, and all of the Bank’s subsidiaries or affiliates, without prior notice to the Client, to make any and all disclosure of information regarding the account as may be required. The Client hereby holds the Bank, its directors, officers, employees and other duly authorized representatives free and harmless against any and all liability arising from any loss or damage which the Client may incur or suffer as a result of such disclosure.
        • 1.16 CONSENT TO SHARE INFORMATION – For the purposes of (a) sales and marketing activities, cross-referencing, status inquiry, cross-selling or the offering of the various products and services of the Bank and the Cebuana Lhuillier Group, including but not limited to, credit opinion and evaluation by and for an entity belonging to the Cebuana Lhuillier Group, or application for insurance products with an insurance company within Cebuana Lhuillier Group; (b) compliance with legal, regulatory or other contractual obligations of the Bank; and (c) providing efficient services, the Client hereby gives its consent to, and authorizes the Bank to process, obtain, collect, record, organize, store, update, modify, use, access and/or share/disclose within the Cebuana Lhuillier Group and third party service providers, with corresponding duty to keep such information confidential, without prior notice to the Client, relevant account information/data/opinion pertaining to the Client, including but not limited to personal circumstances, privileged information, sensitive personal information, account opening, account balances, transaction history, promo subscription, redemption records and any and all other information pertaining to all account/s now existing or which may hereafter to be opened, which authorization shall constitute a consent and shall exempt the Bank and/or the Cebuana Lhuillier Group from liability under any and all bank deposit secrecy laws, including but not limited to, R.A. 1405 or The Law on Secrecy of Bank Deposits, R.A. 6426 or The Foreign Currency Deposit Act and R.A. 8791 or The General Banking Law, as well as R.A. 10173 or the Data Privacy Act of 2012 and other confidentiality laws enforced or which may hereinafter enforced. The absence of any written notice to the contrary shall be deemed by the Bank as the Client’s continuing consent under the bank secrecy, privacy and confidentiality laws, as abovementioned. The Client shall notify the branch in writing if he /she wishes to withdraw the consent to the sharing of information provided herein.

As required by Bangko Sentral ng Pilipinas (BSP), clients who engage in a financial transaction with covered institutions for the first time shall be required to present the original and submit a clear copy of at least ONE (1) valid photo-bearing identification document issued by an official authority. For our clients’ convenience, Cebuana no longer requires submission of the photocopied ID. IDs are captured using a webcam in all branches. Clients are also required to submit an updated photo and other relevant information whenever the need for it arises.
